DECYZJA WYKONAWCZA KOMISJI (UE) 2025/2300
z dnia 6 listopada 2025 r.
zmieniająca załącznik do decyzji wykonawczej (UE) 2023/2447 dotyczącej środków nadzwyczajnych w odniesieniu do ognisk wysoce zjadliwej grypy ptaków w niektórych państwach członkowskich

KOMISJA EUROPEJSKA,
uwzględniając Traktat o funkcjonowaniu Unii Europejskiej,
uwzględniając rozporządzenie Parlamentu Europejskiego i Rady (UE) 2016/429 z dnia 9 marca 2016 r. w sprawie przenośnych chorób zwierząt oraz zmieniające i uchylające niektóre akty w dziedzinie zdrowia zwierząt („Prawo o zdrowiu zwierząt”) (1), w szczególności jego art. 259 ust. 1 lit. c),
a także mając na uwadze, co następuje:
| (1) | Wysoce zjadliwa grypa ptaków jest wirusową chorobą zakaźną ptaków i może wywierać poważny wpływ na rentowność gospodarstw drobiarskich, co z kolei powoduje zakłócenia w handlu wewnątrz Unii oraz w wywozie do państw trzecich. Wirusy wysoce zjadliwej grypy ptaków mogą zakażać ptaki migrujące i być przez nie następnie przenoszone na duże odległości podczas ich jesiennych i wiosennych migracji. Występowanie wirusów wysoce zjadliwej grypy ptaków u dzikiego ptactwa stwarza zatem stałe zagrożenie bezpośredniego i pośredniego wprowadzenia tych wirusów do gospodarstw, w których utrzymuje się drób lub ptaki żyjące w niewoli. W przypadku wystąpienia ogniska wysoce zjadliwej grypy ptaków istnieje ryzyko, że czynnik chorobotwórczy rozprzestrzeni się na inne gospodarstwa, w których utrzymuje się drób lub ptaki żyjące w niewoli. |
| (2) | W rozporządzeniu (UE) 2016/429 ustanowiono ramy prawne w zakresie zapobiegania chorobom przenoszonym na zwierzęta lub ludzi oraz zwalczania tych chorób. Wysoce zjadliwa grypa ptaków wchodzi w zakres definicji choroby umieszczonej w wykazie w tym rozporządzeniu i podlega ustanowionym w nim przepisom dotyczącym zapobiegania chorobom i ich zwalczania. Ponadto rozporządzenie delegowane Komisji (UE) 2020/687 (2) uzupełnia rozporządzenie (UE) 2016/429 w odniesieniu do przepisów dotyczących zapobiegania niektórym chorobom umieszczonym w wykazie i ich zwalczania, łącznie z wysoce zjadliwą grypą ptaków. W szczególności art. 21 tego rozporządzenia delegowanego stanowi, że w przypadku wystąpienia ogniska choroby kategorii A w zakładzie właściwy organ niezwłocznie ustanawia obszar objęty ograniczeniami, na który składają się obszar zapowietrzony, obszar zagrożony oraz, w razie potrzeby, obszary buforowe wokół lub w sąsiedztwie obszarów zapowietrzonego i zagrożonego. |
| (3) | Decyzję wykonawczą Komisji (UE) 2023/2447 (3) przyjęto na podstawie rozporządzenia (UE) 2016/429 i ustanowiono w niej środki nadzwyczajne na poziomie Unii w odniesieniu do ognisk wysoce zjadliwej grypy ptaków. |
| (4) | W szczególności art. 2 lit. a), art. 3 lit. a) oraz art. 4 lit. a) decyzji wykonawczej (UE) 2023/2447 - odpowiednio - przewidują, że w następstwie wystąpienia ognisk wysoce zjadliwej grypy ptaków obszary zapowietrzone, zagrożone i buforowe, które mają zostać ustanowione zgodnie z rozporządzeniem delegowanym (UE) 2020/687 przez właściwe organy państw członkowskich, wymienione w załączniku do tej decyzji, muszą obejmować co najmniej obszary wymienione jako obszary zapowietrzone, zagrożone i buforowe w tym załączniku. Art. 2 lit. b), art. 3 lit. b) oraz art. 4 lit. b) decyzji wykonawczej (UE) 2023/2447 również stanowią, że środki, które mają być stosowane na tych obszarach zapowietrzonych, zagrożonych i buforowych zgodnie z tym rozporządzeniem delegowanym, muszą być utrzymane co najmniej do dat określonych w załączniku do tej decyzji wykonawczej. |
| (5) | Załącznik do decyzji wykonawczej (UE) 2023/2447 został niedawno zmieniony decyzją wykonawczą Komisji (UE) 2025/2213 (4) w związku z wystąpieniem ognisk wysoce zjadliwej grypy ptaków w zakładach, w których utrzymywany jest drób lub ptaki żyjące w niewoli, w Bułgarii, we Francji, w Niemczech, we Włoszech, na Litwie, w Polsce, na Słowacji, w Hiszpanii i w Zjednoczonym Królestwie w odniesieniu do Irlandii Północnej, które to ogniska należało uwzględnić w tym załączniku. |
| (6) | Od dnia przyjęcia decyzji wykonawczej (UE) 2025/2213 Belgia, Dania, Francja, Niemcy, Węgry, Włochy, Niderlandy, Polska i Szwecja powiadomiły Komisję o wystąpieniu 48 nowych ognisk wysoce zjadliwej grypy ptaków w tych państwach członkowskich w zakładach, w których utrzymuje się drób lub ptaki żyjące w niewoli. Powiadomienia dotyczyły w szczególności dwóch ognisk u drobiu w prowincji Antwerpia i West-Vlaanderen w Belgii, trzech ognisk u drobiu w Danii Południowej i w prowincji Zelandia w Danii, pięciu ognisk u drobiu w departamentach Allier, Cher, Côte-d'Or, Marne i Haute-Marne we Francji, 17 ognisk u drobiu w krajach związkowych Badenia-Wirtembergia, Brandenburgia, Meklemburgia-Pomorze Przednie, Dolna Saksonia, Nadrenia Północna-Westfalia i Szlezwik-Holsztyn w Niemczech, jednego ogniska u drobiu w komitacie Jász-Nagykun-Szolnok na Węgrzech, 11 ognisk u drobiu w regionach Emilia-Romania, Lombardia i Piemont we Włoszech, dwóch ognisk u drobiu i dwóch ognisk u ptaków żyjących w niewoli w prowincji Geldria w Niderlandach, czterech ognisk u drobiu w województwach warmińsko-mazurskim i wielkopolskim w Polsce oraz jednego ogniska u drobiu w prowincji Skania w Szwecji. |
| (7) | W związku z tymi 48 nowymi ogniskami Belgia, Dania, Francja, Niemcy, Węgry, Włochy, Niderlandy, Polska i Szwecja wprowadziły środki zwalczania chorób wymagane zgodnie z rozporządzeniem delegowanym (UE) 2020/687, w tym ustanowiły obszary zapowietrzone i zagrożone wokół tych ognisk. |
| (8) | Ponadto ognisko potwierdzone przez Belgię w prowincji Antwerpia oraz ognisko potwierdzone przez Niemcy w kraju związkowym Nadrenia Północna-Westfalia znajdują się w bliskim sąsiedztwie odpowiednich granic z Niderlandami. Ponieważ obszary zagrożone w Belgii i Niemczech rozciągają się na terytorium Niderlandów, właściwe organy Belgii i Niemiec należycie współpracowały z właściwym organem Niderlandów w celu ustanowienia niezbędnych obszarów zagrożonych zgodnie z rozporządzeniem delegowanym (UE) 2020/687. |
| (9) | Ponadto właściwy organ Polski podjął decyzję o ustanowieniu kolejnego obszaru buforowego przylegającego do obszarów zapowietrzonych i zagrożonych ustanowionych w następstwie wystąpienia ognisk na obszarze w województwie warmińsko-mazurskim, na którym występuje zwiększone ryzyko rozprzestrzeniania się wysoce zjadliwej grypy ptaków. |
| (10) | Komisja zbadała środki zwalczania chorób wprowadzone przez Belgię, Danię, Francję, Niemcy, Węgry, Włochy, Niderlandy, Polskę i Szwecję i stwierdziła, że granice obszarów zapowietrzonych i zagrożonych ustanowionych przez te państwa członkowskie oraz granice obszaru buforowego w Polsce znajdują się w wystarczającej odległości od zakładów, w których potwierdzono wystąpienie ognisk wysoce zjadliwej grypy ptaków. |
| (11) | Aby zapobiec niepotrzebnym zakłóceniom w handlu wewnątrz Unii, a także uniknąć wprowadzenia przez państwa trzecie nieuzasadnionych zakłóceń w handlu, konieczne jest niezwłoczne określenie na poziomie Unii, we współpracy z Belgią, Danią, Francją, Niemcami, Węgrami, Włochami, Niderlandami, Polską i Szwecją, obszarów zapowietrzonych i zagrożonych ustanowionych przez te państwa członkowskie oraz granic obszaru buforowego w Polsce zgodnie z rozporządzeniem delegowanym (UE) 2020/687. |
| (12) | W związku z tym należy dostosować obszary wymienione w załączniku do decyzji wykonawczej (UE) 2023/2447 jako obszary zapowietrzone i zagrożone w Danii, we Francji, w Niemczech, we Włoszech, w Niderlandach i w Polsce, a także obszary wymienione jako obszary buforowe w Polsce, tak aby uwzględniały one granice obszarów zapowietrzonych i zagrożonych ustanowionych przez te państwa członkowskie oraz granice obszaru buforowego w Polsce w związku z wystąpieniem nowych ognisk wysoce zjadliwej grypy ptaków w tych państwach członkowskich; należy także zmienić wymagany okres obowiązywania środków, które mają być stosowane na tych obszarach, zgodnie z rozporządzeniem delegowanym (UE) 2020/687. |
| (13) | Żadne obszary Belgii, Węgier ani Szwecji nie są obecnie wymienione w załączniku do decyzji wykonawczej (UE) 2023/2447 jako obszary zapowietrzone lub zagrożone. W związku z tym obszary Belgii, Węgier i Szwecji, na których wystąpiły te ogniska choroby, należy wymienić w tym załączniku jako obszary zapowietrzone i zagrożone, tak aby uwzględniały one granice obszarów zapowietrzonych i zagrożonych ustanowionych przez te państwa członkowskie w związku z niedawnym wystąpieniem ognisk wysoce zjadliwej grypy ptaków na ich odpowiednich terytoriach; należy także ustanowić okres obowiązywania środków, które mają być stosowane na tych obszarach, zgodnie z rozporządzeniem delegowanym (UE) 2020/687. |
| (14) | Należy zatem odpowiednio zmienić załącznik do decyzji wykonawczej (UE) 2023/2447. |
| (15) | Ze względu na pilny charakter sytuacji epidemiologicznej w Unii w odniesieniu do rozprzestrzeniania się wysoce zjadliwej grypy ptaków ważne jest, aby zmiany wprowadzone niniejszą decyzją w decyzji wykonawczej (UE) 2023/2447 stały się skuteczne tak szybko, jak jest to możliwe. |
| (16) | Środki przewidziane w niniejszej decyzji są zgodne z opinią Stałego Komitetu ds. Roślin, Zwierząt, Żywności i Pasz, |
PRZYJMUJE NINIEJSZĄ DECYZJĘ:
Artykuł 1
Załącznik do decyzji wykonawczej (UE) 2023/2447 zastępuje się tekstem znajdującym się w załączniku do niniejszej decyzji.
Artykuł 2
Niniejsza decyzja skierowana jest do państw członkowskich.
