DECYZJA WYKONAWCZA KOMISJI (UE) 2026/923

zmieniająca decyzję wykonawczą (UE) 2026/582 dotyczącą niektórych środków nadzwyczajnych w odniesieniu do pryszczycy na Cyprze

KOMISJA EUROPEJSKA,
uwzględniając Traktat o funkcjonowaniu Unii Europejskiej,
uwzględniając rozporządzenie Parlamentu Europejskiego i Rady (UE) 2016/429 z dnia 9 marca 2016 r. w sprawie przenośnych chorób zwierząt oraz zmieniające i uchylające niektóre akty w dziedzinie zdrowia zwierząt („Prawo o zdrowiu zwierząt”) (1), w szczególności jego art. 259 ust. 1,
a także mając na uwadze, co następuje:
| (1) | Pryszczyca jest zakaźną chorobą wirusową występującą u ssaków z rzędów parzystokopytnych i trąbowców, która może mieć poważny wpływ na odnośną populację zwierząt i rentowność chowu, powodując zakłócenia w przemieszczaniu przesyłek tych zwierząt i pozyskanych od nich lub z nich produktów w Unii oraz w wywozie do państw trzecich. W przypadku wystąpienia ogniska pryszczycy u zwierząt istnieje poważne ryzyko rozprzestrzenienia się tej choroby na inne zakłady, w których utrzymywane są zwierzęta należące do gatunków umieszczonych w wykazie określonym w załączniku do rozporządzenia wykonawczego Komisji (UE) 2018/1882 (2) (gatunki umieszczone w wykazie). |
| (2) | Rozporządzenie delegowane Komisji 2020/687 (3) uzupełnia przepisy dotyczące zwalczania chorób umieszczonych w wykazie, o których mowa w art. 9 ust. 1 lit. a), b) i c) rozporządzenia (UE) 2016/429, i zdefiniowanych jako choroby kategorii A, B i C w rozporządzeniu wykonawczym (UE) 2018/1882. W szczególności w art. 21 i 22 rozporządzenia delegowanego (UE) 2020/687 przewidziano ustanowienie obszaru objętego ograniczeniami w przypadku wystąpienia ogniska choroby kategorii A, w tym pryszczycy, oraz przewidziano stosowanie na nim niektórych środków. Ponadto art. 21 ust. 1 tego rozporządzenia delegowanego stanowi, że obszar objęty ograniczeniami obejmuje obszar zapowietrzony i obszar zagrożony, a także, w razie potrzeby, obszary buforowe wokół lub w sąsiedztwie obszarów zapowietrzonego i zagrożonego. |
| (3) | Decyzję wykonawczą Komisji (UE) 2026/582 (4) przyjęto na podstawie rozporządzenia (UE) 2016/429 i ustanowiono w niej niektóre środki nadzwyczajne w odniesieniu do ognisk pryszczycy w zakładach, w których utrzymywane są przeżuwacze, znajdujących się w dystryktach Larnaka i Nikozja na Cyprze. W szczególności decyzja wykonawcza (UE) 2026/582 stanowi, że Cypr musi ustanowić obszary objęte ograniczeniami obejmujące obszary zapowietrzone i zagrożone oraz obszar buforowy, zgodnie z art. 21 rozporządzenia delegowanego (UE) 2020/687, przy czym środki, których stosowanie jest wymagane na obszarach zapowietrzonych i zagrożonych stosuje się co najmniej do dat wymienionych w załączniku do tej decyzji wykonawczej, a obszary zapowietrzone i zagrożone oraz obszar buforowy muszą obejmować co najmniej obszary wymienione w tym załączniku. Decyzja wykonawcza (UE) 2026/582 została zmieniona decyzją wykonawczą Komisji (UE) 2026/782 (5). |
| (4) | Od momentu przyjęcia decyzji wykonawczej (UE) 2026/782 dokonano – na podstawie informacji przedstawionych przez Cypr – przeglądu środków nadzwyczajnych, których stosowanie jest wymagane na obszarach zapowietrzonych i zagrożonych oraz obszarze buforowym, wymienionych w załączniku do tej decyzji, oraz harmonogramu ich stosowania, w szczególności w odniesieniu do dat wstępnego oczyszczania i dezynfekcji zakładów dotkniętych chorobą, których przeprowadzenie jest wymagane zgodnie z rozporządzeniem delegowanym (UE) 2020/687. W związku z tym należy zmienić czas obowiązywania środków nadzwyczajnych na tych obszarach zapowietrzonych i zagrożonych. |
| (5) | Ponadto od czasu przyjęcia decyzji wykonawczej (UE) 2026/782 wystąpiły kolejne ogniska pryszczycy w zakładach w dystryktach Larnaka i Nikozja na Cyprze, w tym poza obszarami wymienionymi jako obszary zapowietrzone i zagrożone w załączniku do decyzji wykonawczej (UE) 2026/582. |
| (6) | W związku z tym, biorąc pod uwagę obecną sytuację epidemiologiczną w odniesieniu do pryszczycy na Cyprze oraz aby zapobiec dalszemu rozprzestrzenianiu się tej choroby w tym państwie członkowskim, do innych państw członkowskich lub do państw trzecich, należy pilnie dokonać przeglądu obecnych obszarów wymienionych jako obszary zapowietrzone, zagrożone lub buforowe w załączniku do decyzji wykonawczej (UE) 2026/582, aby je dostosować zarówno pod względem przestrzennym, jak i czasowym, a także ustanowić nowe obszary zapowietrzone i zagrożone, biorąc pod uwagę najnowsze ogniska na Cyprze. Jest to również konieczne, aby zapobiec niepotrzebnym zakłóceniom w handlu wewnątrz Unii oraz uniknąć wprowadzenia przez państwa trzecie nieuzasadnionych barier w handlu. |
| (7) | Należy zatem odpowiednio zmienić decyzję wykonawczą (UE) 2026/582. |
| (8) | Środki przewidziane w niniejszej decyzji są zgodne z opinią Stałego Komitetu ds. Roślin, Zwierząt, Żywności i Pasz, |
PRZYJMUJE NINIEJSZĄ DECYZJĘ:
Artykuł 1
Załącznik do decyzji wykonawczej (UE) 2026/582 zastępuje się tekstem znajdującym się w załączniku do niniejszej decyzji.
Artykuł 2
Niniejsza decyzja skierowana jest do Republiki Cypryjskiej.
