Na podstawie art. 18 ust. 2 pkt 15, art. 40 ust. 1, art. 41 ust. 1 i art. 42 ustawy z dnia 8 marca 1990 r. o samorządzie gminnym (Dz. U. z 2016 r. poz. 446) oraz art. 6n ustawy z dnia 13 września 1996 r. o utrzymaniu czystości i porządku w gminach (Dz. U. z 2016 r. poz. 250)

uchwala:

§ 1.

Określa się wzór deklaracji o wysokości opłaty za gospodarowanie odpadami komunalnymi składanej przez właścicieli nieruchomości, na których zamieszkują mieszkańcy, stanowiący załącznik nr 1 do niniejszej uchwały.

§ 2.

Deklarację, o której mowa w § 1 właściciel nieruchomości jest obowiązany złożyć w Urzędzie Gminy Kalety pisemnie lub w formie elektronicznej za pośrednictwem Platformy Elektronicznych Usług Administracji Publicznej pod adresem: http://www.epuap.gov.plw terminach określonych w art. 6m ust. 1 i 2 ustawy o utrzymaniu czystości i porządku w gminach.

§ 3.

1. Format elektroniczny deklaracji, o której mowa w § 1, określa się jako format danych XML.

2. Układ informacji i powiązań między nimi określa załącznik nr 2 do niniejszej uchwały.

3. Deklaracja przesyłana w formie elektronicznej musi być opatrzona bezpiecznym podpisem elektronicznym weryfikowanym za pomocą ważnego kwalifikowanego certyfikatu w rozumieniu ustawy z dnia 18 września 2001 r. o podpisie elektronicznym (Dz. U. z 2013 r. poz. 262, z 2014 r. poz. 1662 oraz z 2015 r. poz. 1893) lub podpisem potwierdzonym profilem zaufanym w rozumieniu ustawy z dnia 17 lutego 2005 r. o informatyzacji działalności podmiotów realizujących zadania publiczne (Dz. U. z 2014 r. poz. 1114).

§ 4.

Deklaracje o wysokości opłaty za gospodarowanie odpadami komunalnymi złożone do dnia wejścia w życie niniejszej uchwały na drukach ustalonych przepisami dotychczas obowiązującymi zachowują ważność.

§ 5.

Wykonanie uchwały powierza się Burmistrzowi Miasta Kalety.

§ 6.

Traci moc uchwała Nr 140/XVIII/2016 Rady Miejskiej w Kaletach z dnia 21 czerwca 2016 r. w sprawie wzoru deklaracji o wysokości opłaty za gospodarowanie odpadami komunalnymi składanej przez właścicieli nieruchomości zamieszkałych.

§ 7.

Uchwała podlega ogłoszeniu w Dzienniku Urzędowym Województwa Śląskiego i wchodzi w życie po upływie 14 dni od dnia jej ogłoszenia.
