KOMISJA EUROPEJSKA,

uwzględniając Traktat o funkcjonowaniu Unii Europejskiej,

uwzględniając dyrektywę Rady 89/662/EWG z dnia 11 grudnia 1989 r. dotyczącą kontroli weterynaryjnych w handlu wewnątrzwspólnotowym w perspektywie wprowadzenia rynku wewnętrznego (1), w szczególności jej art. 9 ust. 3,

uwzględniając dyrektywę Rady 90/425/EWG z dnia 26 czerwca 1990 r. dotyczącą kontroli weterynaryjnych mających zastosowanie w handlu wewnątrzunijnym niektórymi żywymi zwierzętami i produktami w perspektywie wprowadzenia rynku wewnętrznego (2), w szczególności jej art. 10 ust. 3,

a także mając na uwadze, co następuje:

Decyzja wykonawcza Komisji (UE) 2020/1606 (3) została przyjęta w następstwie wystąpienia ogniska wysoce zjadliwej grypy ptaków podtypu H5N8 w jednym gospodarstwie, w którym utrzymuje się drób, w Niderlandach oraz ustanowienia obszarów zapowietrzonych i zagrożonych przez właściwy organ tego państwa członkowskiego zgodnie z dyrektywą Rady 2005/94/WE (4).

(2)	W decyzji wykonawczej (UE) 2020/1606 przewiduje się, że obszary zapowietrzone i zagrożone ustanowione przez Niderlandy zgodnie z dyrektywą 2005/94/WE powinny obejmować co najmniej obszary wymienione jako obszary zapowietrzone i zagrożone w załączniku do wspomnianej decyzji wykonawczej.

Od czasu przyjęcia decyzji wykonawczej (UE) 2020/1606 Niderlandy powiadomiły Komisję o wystąpieniu dodatkowego ogniska wysoce zjadliwej grypy ptaków podtypu H5N8 w gospodarstwie, w którym utrzymuje się drób, w prowincji Geldria, oraz wprowadziły niezbędne środki wymagane zgodnie z dyrektywą 2005/94/WE, w tym ustanowiły obszary zapowietrzone i zagrożone wokół tego nowego ogniska.

Komisja we współpracy z Niderlandami zbadała te środki i stwierdziła, że granice obszarów zapowietrzonych i zagrożonych wyznaczone przez właściwy organ w tym państwie członkowskim znajdują się w wystarczającej odległości od gospodarstw, w których potwierdzono ognisko wysoce zjadliwej grypy ptaków podtypu H5N8.

W celu zapobieżenia niepotrzebnym zakłóceniom w handlu wewnątrz Unii, a także aby uniknąć wprowadzenia przez państwa trzecie nieuzasadnionych barier w handlu, konieczne jest niezwłoczne określenie na poziomie Unii, we współpracy z Niderlandami, nowych obszarów zapowietrzonych i zagrożonych ustanowionych w tym państwie członkowskim zgodnie z dyrektywą 2005/94/WE. Należy zatem zmienić wykaz obszarów zapowietrzonych i zagrożonych dla Niderlandów w załączniku do decyzji wykonawczej (UE) 2020/1606.

W związku z tym, w oczekiwaniu na następne posiedzenie Stałego Komitetu ds. Roślin, Zwierząt, Żywności i Pasz, należy zmienić załącznik do decyzji wykonawczej (UE) 2020/1606, aby zaktualizować podział na obszary na poziomie Unii w celu zmiany obszarów zapowietrzonych i zagrożonych ustanowionych przez Niderlandy zgodnie z dyrektywą 2005/94/WE oraz czasu trwania ograniczeń mających na nich zastosowanie.

(7)	Należy zatem odpowiednio zmienić decyzję wykonawczą (UE) 2020/1606.

Ze względu na pilny charakter sytuacji epidemiologicznej w Unii w odniesieniu do rozprzestrzeniania się wysoce zjadliwej grypy ptaków podtypu H5N8 ważne jest, aby zmiany wprowadzone niniejszą decyzją w załączniku do decyzji wykonawczej (UE) 2020/1606 stały się skuteczne tak szybko, jak jest to możliwe.

(9)	Stały Komitet ds. Roślin, Zwierząt, Żywności i Pasz dokona przeglądu niniejszej decyzji na swoim następnym posiedzeniu,

PRZYJMUJE NINIEJSZĄ DECYZJĘ:

Artykuł 1

Załącznik do decyzji wykonawczej (UE) 2020/1606 zastępuje się tekstem znajdującym się w załączniku do niniejszej decyzji.

Artykuł 2

Niniejsza decyzja skierowana jest do Królestwa Niderlandów.
